In order to use Zortt or any of it's services, you must read and agree to the Zortt terms of service below. Our terms of service is broken up into sections, not all sections may apply to you. Once you have read and agreed to the zortt terms of service, you will stop seeing this notice and will be eligible to proceed forward with using any Zortt services. You must accept these terms before proceeding. Failure to accept these terms will result in your account being inaccesable.

Creating An Account & Enrollment


By opening and using a Zortt account or using any Zortt services, you agree to comply with all of the terms and conditions in this agreement. Please read carefully all of the terms and conditions of this user agreement, terms of these policies and each of the other agreemnts that apply to you.

This user agreement is a contract between you and Zortt LLC. governing your use of your Zortt account and the Zortt services. This contract applies to U.S Zortt accounts only. If you are an individual, you must be a resident in the United States or one of it's territories and at least 18 years of age to open a Zortt account and use the Zortt services. If you are a business, the business must be organized in, operating in, or a resident of, the United States or in one of its Territories to open a U.S Zortt account and to use the Zortt services.

We may revise this agreement and any of the policies listed above from time to time. The revised version will be effective at the time we post it, unless otherwise noted. If our changes reduce your rights or increase your responsibilities we will post a notice on the Policy Updates page of our website and provide you at least 15 days advance notice for all Zortt accounts. By continuing to use our services after any changes to this user agreement, you agree to abide by and be bound by those changes. If you do not agree with any changes to this user agreement, you may close your account.

Zortt Accounts


Zortt accounts are any accounts that are created on or from Zortt.com or any other Zortt.com affiliate. Additional terms may be used to define Zortt accounts, such as "profiles", "accounts". These are both reduced to mean "Zortt Accounts".

You may only use our service if you meet the following requirements :
  • You are at least 18 years old;
  • You are legally allowed to use our Services where you live;
  • You are not using our services on behalf of another entity, or person(s), such as a company, or organization;
  • You have not been previously banned from Zortt services.

When joining and signing up (contingent on being eligible for a Zortt account), you agree to the following requirements, and understand our policies as outlined above and below.

  • You have a legal right to post content to our Services;
  • Any content you post and the reason for you posting it meets all local and federal laws, rules and reulgations;
  • Any content you post does not infringe on intellectual property rights, copyrights, or trademarks of another individual or entity;

Note: Zortt accounts are for access to the core Zortt functions and features. Each function and feature may have additional requirements, or additional terms related to them based upon what the function or feature is. The continuation of this terms of service will outline if and what those requirements are.

Closing Your Zortt Account


You may close your Zortt account and terminate your relationship with us at any time without cost, but you will remain liable for all obligations related to your Zortt account even after the Zortt account is closed. When you close your Zortt account, we will cancel any scheduled or incomplete transactions. If you have an expected payout to you, this payout will not be completed once your account is cancelled. You will be eligible to withdraw your funds after an account is closed by contacting our billing team directly at billing@zortt.com. Please ensure to reference your ZID. Zortt reserves the right to store information and media provided by you unless notice of being legally required to remove specific data is provided to us in writing by a person or entity that has the authority to request or require this action. In certain cases you will NOT be eligible to close your account - these instances are listed below:

Forbidden instances of account closure:
  • To evade an investigation by Zortt, or the authorities;
  • If you have a pending transaction or an open dispute, or claim;
  • If your Zortt account has a negative balance;
  • If your Zortt account is subject to a hold, limitation, or administrative action;

Receiving Funds, Holding Balances, and Transferring Funds


Money sent to your Zortt account can not be held as a balance in your Zortt account indefinitely. When you receive money to your Zortt account, you must do one of the following :

Zortt Balance Allowables:
  • Transfer money from your Zortt Wallet to a personal bank account (or other organization capable of legally holding funds) linked to your Zortt account within 5 days;
  • Transfer money from your Zortt wallet to another Zortt account;
  • Request Zortt send you a check for the balance (subject to a non-refundable fee of $5.00, which will be deducted from the amount of the withdrawal). If you request a paper check from us, you must cash it within 120 days of the date of issuance, or we will return the funds back to your Zortt account if you have one, or, hold the funds on your behalf and retain the non-refundable fee of $5.00. We will not send a check to a post office box, and we will only send a check to an address once we have confirmed that the address belongs to you;
  • Use your account funds to purchase goods or services from the Zortt marketplace, or directly from Zortt LLC services and products family.
  • Use the balance of Zbuck points to deposit them onto a Zortt Spend Card;

Except as provided below, any balance in your Zortt account and any funds sent to you which have not yet been transferred to a linked bank account or another Zortt account within Zortt, represents an unsecured claim against Zortt and is not insured by the Federal Deposit Insurance Corporation (FDIC).

Zortt is not a bank and does not itself take deposits. You will not receive any interest on the funds held with Zortt. Zortt combines your Zortt funds with the Zortt funds of other Zortt users and invests those funds in liquid investments in accordance with state money transmitter laws. Zortt owns the interest or other earnings on these investments. These pooled amounts are held apart from Zortt’s corporate funds, and Zortt will neither use these funds for its operating expenses or any other corporate purposes nor will it voluntarily make these funds available to its creditors in the event of bankruptcy.

Restrictions on Transfers or Withdrawals from Zortt Accounts:

To protect us and our users from loss, we may delay a withdrawal in certain situations, including if we need to confirm that you have authorized the withdrawal or if other payments to your Zortt account have been subject to a reversal (for example, as a result of a chargeback, bank reversal or dispute by another user). If we place a limitation on your Zortt account, or a payment is subject to a hold, or your account or an associated account has a negative balance in any currency (Zbucks) while a withdrawal from your Zortt account is pending, you will have to reinitiate the withdrawal once the limitation or hold has been lifted, or negative balance is fully paid off.

We may set limits on your withdrawals, and you can view any withdrawal limit by logging into your Zortt account. Completing two out of three of the following steps can help us verify your Zortt account, which may allow us to remove any withdrawal cap:

  • Verifying your bank account;
  • Verifying your identity with state issued documents;
  • Providing your social security number.

Zortt also imposes fees for withdrawing money from your Zortt wallet. Please review the Fee structure for withdrawing money below.

  • A one time account fee of $2.00 will be processed to enable account withdrawals;
  • A 1.5% fee will be deducted from your withdrawal with a maximum of $25 dollars, whichever is smaller;
  • Funds are available to you within 3 - 5 business days of requesting a withdrawal if the request is eligible;
  • You can withdraw a maximum of $5,000 per day.

Sending Money:

You can send money to a friend, colleague, family member using the Zbuck wallet feature in your Zortt account. You can send money to a friend or family member even if they do not have a Zortt account at the time of you sending money, using their phone number. If the person you're sending money to does not have a Zortt account, they can claim the funds my opening a Zortt account. If they do not claim the funds, the funds will be refunded to you after 10 days.

We may however; at our discretion, impose limits on the amount of money you can send, including money intended for purchases on the Zortt market (Also referred to as the Zmarketplace, or Zmarket). You can view and limits on your funds by logging into your Zwallet. Any notices of limitations will be announced at the top of your wallet.

When you send money to another person on the Zortt network the money is deposited into the account if the account exists. If the account does not exist, it must be claimed within 10 days. The other party does not have the option to decline, or accept the money you have sent them. Transactions are non refundable and must be manually sent back to you by the other party (To whom you sent the funds).

If funds were sent for goods or services but not used in our checkout experience, those funds are not eligible to be disputed with us.

Fees for sending money to people (Friends, Family, etc):

Our applicable fee schedule can be found below. This will also be disclosed to you in advance of you requesting money, or sending money to another party:

When sending money to other people for any reason, there is NO FEE

When making a purchase in the Zmarket, the fee is 3.2% of the transaction amount.

Promoters & Bonus Pools:


Promoters are entered into a bonus pool that allows them access to earn money based on the total gross sales of zortt products. Eligible Zortt products are defined below:

  • Any product sold by Zortt LLC, not including products in the marketplace.
  • Any level of charter membership purchased on Zortt.com
  • Zcard Zmodules
  • All other sales on Zortt are not counted towards the total gross sales bonus pool

Zortt allows promoters to have as many shares as they wish in the bonus pool, as long as those shares are available. A share costs $1,000 and provides you with 10% of the total gross sales (as defined above) divided by the total number of people in the bonus pool. Since the bonus pool has a share limit of 1,000 shares, the total number of shares in the pool will never exceed 1000.

Note: A share provides no ownership or voting rights in Zortt or any of it's affiliates in any way. A share simply provides you access to profit sharing as defined above. No additional benefits of a share are provided if not expressly written here in this TOS.

Bonus pool gross sales payouts are based on a simple math equation, the math for this equation is listed below.

  • Total gross sales (as defined above) * 10% / total shares = total share value
If you own more than a single share, then the share value would be multiplied by the total number of shares you have.

Zortt shares are transferable to any other user on the Zortt platform. They must have an account to receive any shares you wish to send them. All reported earnings will be made to the account that owns the shares at the time of a payout is made.

Zortt shares are paid out quarterly (Every 3 months). You are paid out via direct deposit, check, or PayPal based on the options you have selected when setting up your bonus pool account. In some cases, a bonus pool payment may not be made to you. If you are not eligible for a payment at the time of issuance, Zortt shall not be required to hold these funds or provide them to you on any future date. The following reasons will exclude payments being made to your account:

  • You have a past debt or owe money to Zortt LLC.
  • You are missing documentation Zortt has asked for.
  • Your account is ineligible based on any of our eligibility requirements (See those below).
  • Your account has been suspended.
  • Your account has been terminated.
  • Your account has not been verfied.
  • We do not have the correct, or enough personal information from you to make a payment.
In orderto quality for the bonus pool you must meet specific eligibility requirements. They are listed below.
  • You must be over the age of 18.
  • You must reside in North America.
  • You must have a valid ITIN, EIN, or Social Security number.
  • Your PayPal account, bank account, or written check name must belong to you.

Any accounts that do not meet the above mentioned criteria may be suspended or disabled.

Consultants and Bonus Pool


Commissions and payments on Zortt are earned by doing various tasks on the Zortt website. This includes certain paid categories, such as consultants, Promoters, and VIP Charter members. You earn commissions on zortt by referring people to Zortt, when the people you referred purchase something, you receive a commission payment in the form of Zbucks. Zbucks are a digitial point system that allows you to redeem them from Zortt at a 1 point per 1 dollar exchange rate. Each point is worth 1 dollars or ( Zbuck ) as we call them. You can withdrawl commissions on zortt once your balance has reached 25 Zbuck points. The method of withdrawl can be via ACH, or via digital spend card offered by zortt. Please see the section titles " Spend cards and Debit card " for pricing and fee's associated with those products. The following roles pay commissions based on sales.


  • Consultants earn 20% from all net sales of a person they referred when purchasing a zortt product.
  • Consultants have access to a 10% bonus pool that is dividted by the total number of consultants on zortt.
  • Consultants must contact any claimed business they have claimed within 48 hours to ensure validity of the data listed under the business account they have claimed or created. Failure to do so may result in the consultants CRM access privilidges being revoked.
  • Any businesses not receiving any contact from the assigned consultant for siz months will lose access to this business. Failure to do so may result in the consultants CRM access privilidges being revoked.
  • consultants are required to leave notes on business profiles when communicating with that business. Failure to do so may result in the consultants CRM access privilidges being revoked.
A consultant is defined as any person that has purchased a consultant franchise from zortt in the amount of $350 USD. Note: Consultants are not paid any commissions on people their referrals refer themselves. Consultants ONLY receive commissions of people they directly referr to Zortt.

In order to be a consultant there is a one time marketing fee of $350 USD. Zortt provides no refunds for any person who choses to pay this fee and gains access to the marketing materials we provide. By paying this fee, you will gain access to the following benefits:

  • Access to the CRM
  • Access to Zortt University
  • A personal virtual business card
  • Additional products and services as seaonsal marketing projects allow

Note: The CRM is defined as a "Content Relationship Manager". It is a set of tools provided by Zortt to all registered consultants to access business information as a way to communicate with businesses to expose them to Zortt products.

Note: Zortt university is defined as an online training portal to provide consultants with access to up to date marketing materials and the means to utilize those marketing materials to better expose businesses to the Zortt products avialable.

Note: The personal virutal business card is not a fully functional Zcard that Zortt sells to consumers. The virutal business card provided to consultants is a marketing tool and part of the benefits of being a consultant.

While using the CRM, and businesses that the consultant claims, adds, modified, or otherwise edits, belongs to Zortt and can be re-assigned to any other consultant at any time for any reason.


Pioneers:

Pioneers are defined as any one individual that joins and uses Zortt. Pioneers are a term used to describe a normal user on zortt. Anyone on zortt is a pioneer even if they have a different unique title provided to them by Zortt. Pioneers have access to a bonus pool of 10% of the total gross sales on zort that is divided by the total number of people on zortt ( pioneers ). However; the pioneer poor will cap at 1 Million users. Once more than 1 Million users have joined zortt, the pioneer pool will divide total gross sales by 1 Million people. Until 1 Million people have joined Zortt will provide 10% of total gross sales dividied by the total number of registered users.

Creating and Owning Groups on Zortt


Zortt allows for our members to own, and manage groups how they see fit. We provide various tools to allow for our members to create and manage those groups. While Zortt generally allows groups to run the way they want, there are some requirements that we do require to be in place in order to ensure everyone has a safe, fun environment to enjoy. Zortt does not allow the following groups to be created on our platform.

  • Groups that violate any federal or state laws
  • Groups that promote the idea of hate or racism towards any group of people
  • Groups that promote violence towards any group, person, persons, or physical locations
  • Groups you own may not include non-public personal private information belonging to someone else, such as a nother persons birthdate, home adress, or telephone number;
That's it, Otherwise Zortt is a pretty awesome place! We promote the ideology of free speech, uncuriated content, and we're 100% net neutral. Failure to comply with the above group types may result in your group, and the group owner from being removed from Zortt, either temporarily, or indefinitely.

Using Chatter With Images, Videos, and Text


One of the primary uses of zortt is to send communication amongst friends, family, coworkers, etc. You can do this in the form of chatter which allows you to send messages to people on chatter walls. This communication may be seen by others you may not intend to see it. Zortt is an unbiased, net neutral platform, but we do still have a few rules that we require to be met when using our chatter posting capabilities. You can see those listed below.

  • Chatter may not include images of anything that is against the law federally, or in any state that resides in the United States of America
  • Chatter may not include altered images of any single person, or persons showing them doing something they were not initially doing in the image being posted unless you are legally authorized to do so. I.E, the image may not be altered to bully, harass, or otherwise draw embarassment to a person or persons;
  • Chatter may not include words, images, videos, or blogs that are intended to harass another person or persons based on their religion, sexual orientation, or race;
  • Chatter may not include words, images, videos, or blogs to incite violence to any person or persons;
  • Chatter may not include words, images, videos, or blogs to incite violence to any location;
  • Chatter can not infringe on the intellectual property rights (such as copyrights, and the trademark rights) of any other person or entity;
  • Chatter you post may not include non-public personal private information belonging to someone else, such as a nother persons birthdate, home adress, or telephone number;

Creating Events & Managing Events on Zortt


Zortt allows for our members to create, manage, and share events with friends, family, and coworkers. Our event system allows you to create an event in a specific point in time and invite others to this event. Zortt has some requirements for the type of events that we do not allow on our platform. Please review the list provided below.

  • Events that encourage property distruction are not permitted
  • Events that have a sole purpose of targetting a single person, or persons for violence, or harassment, are not permitted.
  • Events that promote the use of anything deemed illegal by the United States, or any states withint he United States.
  • Events you post may not include non-public personal private information belonging to someone else, such as a nother persons birthdate, home adress, or telephone number;

Digital Spend Cards & Physical Spend Cards


Zortt digital spend cards are digital visa cards provided to Zortt users upon request. These cards can be provided at any time for any reason for any user as long as they have an active account on zortt. Virtual spend cards can be issued and used anywhere the Visa card is accepted. Our digital spend card program currently has some restrictions on who can use the product. The following restrictions apply to both digital and physical spend cards.

  • Only US residents are eligible to issue themselves a digital spend card.
  • Digital spend cards are limited to $300 dollars for non verified accounts.
  • Digital spend cards have no limited when an account has been verified.
  • You must be over the age of 18 use to a ditial spend card

The following fee's apply to only digital spend cards:

Note: Digital spend card fees may change at any time for any reason. Our TOS will always be up to date with the latest fees and restrictions. Any notice of change will be send to all users on Zortt. You can find these change notifications in your notification center.

  • Digital cards will have a cost of $3.00 USD
  • Digital cards will have a loading fee of 3% of the total amount you are wanting to add to your card. This fee is deducted from the total cost of the amount you are adding. For example, if you were to add $100 dollars to your spend card, the amount loaded would be $100 less then 3% meaning only $97 dollars would be added to your spend card.

The following fee's apply to only physical spend cards:

Note: Digital spend card fees may change at any time for any reason. Our TOS will always be up to date with the latest fees and restrictions. Any notice of change will be send to all users on Zortt. You can find these change notifications in your notification center.

  • Physical cards will have a cost of $10.00 USD.
  • Physical card will have a loading fee of 3% of the total amount you are wanting to add to your card. This fee is deducted from the total cost of the amount you are adding. For example, if you were to add $100 dollars to your spend card, the amount loaded would be $100 less then 3% meaning only $97 dollars would be added to your spend card.
  • A replacement card can be ordered for a fee of $15.00 USD.

Additional useful information about the spend cards:
  • you can reload your balance using Zbucks only. You can add Zbucks ( points ) to your Zwallet by using a credit card or bank account. There is no fee to add funds to your Zbuck balance using a bank account. There is a 3.2% fee for loading your Zbuck balance with a credit card. The amount will be deducted from the total amount you are depositing.
  • Any fraudulent charges must be reported to Zortt within 90 dars of purchase for any fraudulent charges, or goods not received disputes. Zortt requires proof of the dispute or records within 15 business days of making the dispute with Zortt. Dispute records are any documentation requests that Zortt requests during the dispute filing process.
  • Zortt will provide a temporary credit for the amounts being disputed wtihin 15 days of the dispute being filed. Zortt will provide a determination of the dispute within 45 days from the date the dispute was entered.

Termination of Deposit Services:

We reserve the right to terminate the Mobile Deposit Service at any time without notice to you. We may suspend or terminate your use of the Mobile Deposit Service at any time, with or without cause in our sole discretion. We may suspend or terminate the Mobile Deposit Service without prior notice to you if: you breach any agreement with us; we believe there has been or may be a breach in the security of the Mobile Deposit Service or unauthorized activity involving your Account; or we are uncertain regarding the authorization, completeness, or accuracy of any information you have provided to us. Any termination will not affect obligations arising prior to termination of the card or service we provide.


Other Rights and Obligations Regarding Errors, Unauthorized Transfers, Failure to Make Transfers, and Pre-authorized Payments

You must email dispute@zortt.com as soon as you can if you think an error has occurred in your registered Account. If writing us, a Transaction Dispute Form may be provided for your convenience at www.zortt.com. We must allow you to report an error until 90 days after the earlier of: (i) the date you electronically accessed your Account, provided the error could be viewed in the electronic history; or (ii) the date we sent the FIRST written history on which the error appeared. When notifying us, you will need to tell us:

  • Your name and card number;
  • Why you believe there is an error;
  • the dollar amount invoved in the error;
  • The approximate date in which the error took place;

The above bullet points also apply if you tell us of the dispute orally.

We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will provide a provisional credit to your registered Account within 10 business days for the amount you think is in error, so that you will have the use of the value during the time it takes us to complete the investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your spend card.


Additional rights and Terms:

Disputes with merchants: Neither the Bank nor Zortt is responsible for the delivery, quality, safety, legality, or any other aspect of goods and services that you purchase from others with your Card.

FDIC Insurance: When you have add money to your spend card (This is not to be confused with Zbuck points, Zbuck points are NOT FDIC insured), the money credited to your Spend card will be held in a custodial account at the Bank on your behalf. The amount of money in this custodial account is insured to the maximum limit provided by the FDIC.


NOTICE OF ARBITRATION CLAUSE FOR SPEND CARDS

Your Account is being made available and priced by Zortt LLC on the basis of your acceptance of the following arbitration clause. By using your spend Card or Adding funds to your spend card, you acknowledge that you are giving up the right to litigate Claims (as defined below) if either party elects arbitration of the Claims pursuant to this clause, except as otherwise expressly provided herein, and you hereby knowingly and voluntarily waive the right to trial of all Claims subject to this Agreement. You further acknowledge that you have read this arbitration provision carefully, agree to its terms, and are entering into this Agreement voluntarily and not in reliance on any promises or representations whatsoever except those contained in this Agreement.

Except as expressly provided herein, any claim, dispute, or controversy (whether based upon contract; tort, intentional or otherwise; constitution; statute; common law; or equity and whether pre-existing, present, or future), including initial claims, counter-claims, cross-claims, and third-party claims, arising from or relating to the following:

  • the Card or Account;
  • Any service related to Zortt spend cards
  • Any marketing materials related to any spend cards
this Agreement, including the validity, enforceability, interpretation, scope, or application of this Agreement and this arbitration provision (except for the prohibition on class or other non-individual claims, which shall be for a court to decide); and (v) any other agreement or instrument relating to the Card or Account or any related service (“Claim”) shall be decided, upon the election of you or the Bank (or Zortt, employees, successors, representatives, affiliated companies, or assigns of Zortt), by binding arbitration. Arbitration replaces the right to litigate a Claim in court or to have a jury trial. The American Arbitration Association (“AAA”) shall serve as the arbitration administrator. You may obtain copies of the current rules, forms, and instructions for initiating an arbitration with the AAA by contacting the AAA as follows: online at www.adr.org or by writing to the AAA at: American Arbitration Association, Case Filing Services, 1101 Laurel Oak Road, Suite 100, Voorhees, NJ 08043.

In addition to Claims brought by either you or a bank, Claims made by or against Zortt or by or against anyone connected with you or the Bank or claiming through you or the Bank (including a second cardholder, employee, agent, representative, affiliated company, predecessor or successor, heir, assignee, or trustee in bankruptcy) shall be subject to arbitration as described herein.

We agree not to invoke our right to arbitrate any individual Claim you bring in small claims court or an equivalent court so long as the Claim is pending only in that court. This arbitration provision also does not limit or constrain the Bank’s right to interplead funds in the event of Claims to Account funds by several parties.

Claims may be submitted to arbitration on an individual basis only. Claims subject to this arbitration provision may not be joined or consolidated in arbitration with any Claim of any other person or be arbitrated on a class basis, in a representative capacity on behalf of the general public or on behalf of any other person, unless otherwise agreed to by the parties in writing. However, co-applicants, second cardholders, and authorized users of a single Card and/or related cards are considered as one person, and any Bank, its officers, directors, employees, agents, and affiliates are considered as one person.

If you initiate arbitration, Zortt will advance any arbitration fees, including any required deposit. If Zortt initiates or elects arbitration, zortt will pay the entire amount of the arbitration fees, including any required deposit. Zortt will also be responsible for payment and/or reimbursement of any arbitration fees to the extent that such fees exceed the amount of the filing fees you would have incurred if your Claim had been brought in the state or federal court nearest your residence with jurisdiction over the Claims.

e. A single arbitrator will resolve the Claims. The arbitrator will be a lawyer with at least 10 years’ experience or who is a former or retired judge. The arbitration shall follow the AAA’s rules and procedures in effect on the date the arbitration is filed, except when there is a conflict or inconsistency between the AAA’s rules and procedures and this arbitration provision, in which case this arbitration provision shall govern. Any in-person arbitration hearing for a Claim shall take place within the federal judicial district in which you live or at such other reasonably convenient location as agreed by the parties. The arbitrator shall apply applicable substantive law consistent with the Federal Arbitration Act, 9 U.S.C. §§1 et seq. (the “FAA”), and shall honor all claims of privilege and confidentiality recognized at law. All statutes of limitations that would otherwise be applicable shall apply to any arbitration proceeding. The arbitrator shall be empowered to grant whatever relief would be available in court under law or in equity. Any appropriate court may enter judgment upon the arbitrator’s award. This arbitration provision is made pursuant to a transaction involving interstate commerce and shall be governed by the FAA.

Right to Distribute


you are granting Zortt a license to any content posted by you to the Zortt services, including worldwide, non-exclusive, royalty-free license (With the right to sublicense to any organization, or person(s) we wish) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute your content. You agree that Zortt or it's service providers or partners may display advertising in connection with your content and otherwise monetize your content without compensation to you, unless you are a participant in our influencer program and then you will be compensated according to the terms of that program (Can be found below). You warrant that you have the rights needed to grant these rights to Zortt and other members of the Zortt community. You also grant a limited, non-exclusive, royalty-free, license to any Zortt community member to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute any content posted by you to the Zortt services soley in connection with that member's use of the Zortt services. The licenses granted by you hereunder do not include any moral rights of attribution.

the Services that are provided by Zortt come with no express or implied warranties, except those that cannot be disclaimed under the law.

Zortt DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES AND CONDITIONS, SUCH AS MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Zortt makes no representation or endorsement about the function of the Services or any content available through the Services. Zortt has no responsibility or liability to you arising from your use of the Services. Zortt has no responsibility or liability to you arising from content provided by you or any other person, even if such content is untrue, harmful, damaging, offensive, inappropriate, fraudulent, tortious, unlawful, contrary to social norms, etc. Although Zortt may make efforts to review or monitor content, you agree that you will not rely on this fact for any purpose. Zortt has no responsibility or liability to you arising from hacking event, data breach, theft, misuse of information, conspiracy, racket, fraud, act of terrorism, misappropriation of information, technical malfunction, interruption of service, or similar event that may cause you to suffer damage, loss, or injury, including without limitation any damage to or loss of your personal property, data, operations, information, reputation, goodwill, profits, etc. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND REGARDLESS OF THE NATURE OF THE CAUSE OF ACTION, ZORTT WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR FOR INTANGIBLE LOSSES, ARISING FROM (a) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES; (b) FROM THE ACTS OR OMISSIONS OF ANY OTHER PERSON OR THIRD PARTY, INCLUDING, WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER PERSONS OR THIRD PARTIES; (c) ANY CONTENT OBTAINED FROM THE SERVICES; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR COMMUNICATIONS THROUGH THE SERVICES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ZORTT ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF TWO HUNDRED U.S. DOLLARS (U.S. $200.00) OR THE AMOUNT YOU PAID ZORTT, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND SHALL FURTHER APPLY WHETHER OR NOT ZORTT HAS BEEN INFORMED OF THE POSSIBLITY OF ANY SUCH DAMAGES AND EVEN IF A REMEDY LAID OUT IN THESE TERMS IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE.

You are also agreeing that you are competent and bound by this agreement. This means you are over the age of 18, an emancipated minor, or have legal parental or guardian consent. Parents of minors should be aware that Zortt has no parental management features that can assist them with preventing an under age child from seeing NSFW content on our platform. Zortt suggests no person(s) under the age of 18 join our network.

Term Modification


Zortt may modify the terms outlined herein at any time for any reason. Zortt will notify all members on our platform of any changes in the form of a notification. You will be notified via the Zortt notification system. It is your responsibility to review these changes. In some cases, while we finish our Alpha stage, the changes may be large.
